While not an absolute rule, an estate plan is generally necessary for an individual living in California who either owns real property or, at the time of this writing, more than $150,000.00 in total assets. If you have either or both of the elements listed, then an estate plan, particularly a living trust, will prepare your estate to avoid probate and will adequately distribute your assets after you pass away.

A will, used in conjunction with a living trust, can be a safety net to catch any assets that were left out of the trust. The will “pours over” those assets into the trust in order to distribute them according to the terms of the trust. A will is also necessary if the settlor, the person who established the will, has minor children. The guardianship clauses are included in the will and are the proper place to name the selected guardians who will care for your minor children in the event something happens to you. Heirloom designation (i.e. a wedding ring) can also be mentioned in the will, if necessary.

Powers of attorney and medical health care directives are the means by which you can designate an agent to act on your behalf or to make medical decisions (insignificant to major) on your behalf if you become incapacitated.
